2002年2月18日,拖拉机驾驶员李某为某电力公司运送水泥电杆,并受电力公司委托叫了雷某等5位村民进行装卸,电力公司职工与他们口头约定,完工后付给他们150元作为报酬。雷某等人用电力公司提供的简单工具:绳子和木棍,在电力公司工作人员的指挥下开始装车,但是由于5个人操作不协调,雷某提前顶起电杆,导致电杆从固定处滑落,致使雷某腰椎骨折,经救治,高位截瘫。律师以临时雇佣关系诉电力公司承担赔偿责任。2002年7月法院判决为承揽关系,二审维持原判。雷某不服,经两年多的反复信访,省人民检察院对此提起抗诉,遂发回重审。2005年8月法院再次判决是承揽关系而非雇佣关系。本案的焦点:当事双方究竟是何种法律关系?
