案例:童某,男,23岁,系光明钟表修理店的劳动合同制工人,1994年5月26日入店工作(之前未工作过),合同期3年。今年1月1日,童某双眼患了视网膜脱离症,经系统治疗病情虽然稳定,但矫正视力只有:左眼0.3,右眼0.4。由于他视力差,不能从事原修理钟表工作,单位也无法另安排适当的工作,故在其出院且医疗期满后的第18天就解除其劳动合同。童某认为单位的做法违反《中华人民共和国劳动法》,遂与单位发生了争议。单位处理意见:单位根据劳动部劳部发〔1994〕
