据报道,2013年6月27日晚上7时许,在大连工作的王女士领着3岁半的女儿到高新园区一处工地的小卖店买水,小女孩被院内突然窜出的一条黑色恶犬咬住脖子左侧,送医院抢救后不治身亡。不久,狗主人毕某就被警方刑事拘留,肇事恶犬也被送到犬类留检所收容。这引起社会各界对动物侵权及饲养烈性犬人刑等话题的关注并持续地展开了讨论。事实上,我国对恶犬伤人的案件主要还是采取承担民事责任的方式解决。实践中,恶犬直接伤人情况的责任较容易区分,而对于犬类“非直接攻击”产生的“惊吓型”侵权案件,责任如何承担及受害人如何维权.却鲜有人知晓。
