行政诉讼中事实问题的特殊性在于它审查的是行政机关已认定的事实,涉及到行政权与司法权之间的协调关系。它与法律问题既相互区别又相互联系。司法审查强度是法院对行政行为审查的深浅程度,在一国范围内具有相对确定性,受到权力制约程度、审判模式选择、行政程序的完备程度等因素的影响。我国事实问题司法审查强度应采用多元审查标准。
The particularity of the factual issue in administrative litigation lies in the fact that it examines the fact that the administrative organ has found that it involves the coordination between the executive power and the judicial power. It is different from and interrelated with legal issues. The strength of judicial review is the extent to which the court examines the administrative act, with relative certainty within a country, the degree of power restriction, the choice of trial mode and the degree of completeness of the administrative procedure. The strength of judicial review of factual issues in our country should adopt the multiple review criteria.
