权利人行使权利超过正当界限,有损他人利益或社会利益的,是为权利的滥用,权利滥用应予以禁止。为防止个体私权的不正当使用,各国民法先后确立了禁止权利滥用的原则,本文着重阐述了权利滥用之禁止与自由裁量权的行使之间的关系。
Where the obligee exercises the right beyond the proper limits and undermines the interests of others or the society, it is the abuse of the right and the abuse of the right should be prohibited. In order to prevent the improper use of individual private rights, the civil laws of various countries have successively established the principle of prohibiting the abuse of rights. This article focuses on the relationship between the prohibition of abuse of rights and the exercise of discretion.
