中国对外贸易:请您点评一下拉菲在华商标维权案胜诉的关键点在哪里?张亚洲:在于依据《反不正当竞争法》第五条第(二)项认定拉菲公司的中文“拉菲”系知名商品的特有名称。本案中拉菲提交了大量的证据证明系拉菲公司首先将中文标识“拉菲”使用在葡萄酒产品上,且由于拉菲公司的宣传使得中文“拉菲”深入人心,因此拉菲已经与拉菲公司的“LAFITE”形成一一对应关系,构成了知名商品特有名称。
