为了更好地保障劳动者尤其是农民工的工资权益,《刑法修正案(八)》首次规定恶意欠薪将构成犯罪以及最高法院司法解释明确了恶意欠薪罪的打击力度以及量刑的标准,此文章阐述了恶意欠薪罪的概念、构成要件的基础上,提出了一些恶意欠薪罪存在着的问题以及相关立法对其的规定,从而做到惩罚犯罪,保障人权,实现公平正义。
In order to better protect the wage rights of laborers, especially migrant workers, “the Criminal Law Amendment (8)” provides for the first time that a crime of bad wages will constitute a crime and that the judicial interpretation of the Supreme Court specifies the crackdown on malicious wage crimes and the standard of sentencing, This article elaborates the concept and components of the crime of bad wages, and puts forward some problems existing in the crime of bad wages and the provisions of the relevant legislation so as to punish crimes, safeguard human rights and achieve fairness and justice.
