关税与贸易总协定(GATT)乌拉圭回合多边贸易谈判达成了一揽子协议,其中一个重要成果是通过了《关于执行1994年关贸总协定第6条的协议》(简称《反倾销协议》)。各国以此为蓝本对本国反倾销法作了相应的修改。由于《反倾销协议》在美国不是自动实施以及美国某些利益集团的阻挠,美国政府以“快车道”程序通过了《乌拉圭回合协议法案》(简称《法案》),对反倾销法作了部分修改。本文拟对修改前后的法律规定略作比较和评析。
One of the major achievements of the General Agreement on Tariffs and Trade (GATT) in the Uruguay Round of Multilateral Trade Negotiations was the conclusion of a package of agreements on the implementation of Article 6 of the GATT 1994 (the “Anti-Dumping Agreement”). Based on this, all countries made corresponding amendments to their anti-dumping laws. Because the “anti-dumping agreement” was not implemented automatically in the United States and was obstructed by some interest groups in the United States, the U.S. government passed the Uruguay Round Agreement Act (“Act”) with the “fast track” procedure and partially amended the anti-dumping law. This article intends to make some comparisons and comments on the legal provisions before and after the revision.
