【裁判要旨】以他人商标作为楼盘名称是否侵犯注册商标专用权不能一概而论,而应当严格适用商标类侵权责任的两个构成要件。仅将原告的商标作为小区名称,未将其用于其它宣传行为,不属于商标法上的使用,不会导致相关公众的混淆,没有侵犯原告的注册商标专用权。案号一审:(2011)一中民五初字第8号二审:(2012)津高民三终字第0002号
