一直以来,学术界大都认为,中国近代以前根本没有出现过法治思维。这给全社会导向极大。笔者最近又一次细读古籍,特别是早期王道理论,发现这种论断有失偏颇。箕子王道思想见诸于《尚书·洪范》,提出的年代大约是距今2900年至3000年的周初。(关于箕子作洪范的年代,学界争论不休。本文以最新研究成果,采洪范成于周初说。)自其王道思想问世以来,历朝历代都关注并予以解读。笔者求学初即对其王道理论顶礼膜拜,
