我国农地改革循的是一条自上而下的路径,但其成功终究离不开农民的支持,农地法制建设也不例外。农地习惯法自生自发于农村,与国家制定法相比,有较强的自然性、地域性和属人性。国家法在农村调整的范围和功能是有限的,不可能对农地关系的方方面面都作出具体详尽的规定。农地习惯法弥补了国家制定法的不足,有助于维护乡村秩序,其现实合理性不容忽视。农地习惯法对农地法制建设具有内容上的重要基础、实施过程中的补充修正、程序上的重要参照三大意义。因此在农地改革进程中,应重视农地习惯法的价值,实现农地习惯法与国家法的互动与融合。
The reform of farmland in our country is a top-down path, but its success can not be separated from the support of farmers after all. The construction of legal system of farmland is no exception. The customary law of farmland spontaneously occurs in the rural areas and has stronger natural, regional and human nature than the state law. The scope and functions of state law in rural areas are limited and it is impossible to make any specific detailed stipulation on all aspects of the farmland relations. The customary law of farmland makes up for the insufficiency of state lawmaking and helps to maintain the rural order, whose realistic rationality can not be ignored. The customary law of farmland has an important foundation for the construction of the legal system of farmland, the supplementary amendments in the process of implementation, and the important reference to procedures. Therefore, in the process of agricultural land reform, we should pay attention to the value of customary law of agricultural land and realize the interaction and integration of customary law of farmland and national law.
