如何划分大陆架是中日两国在东中国海问题上的根本分歧点。从国际法的角度分析这一争议,中国主张在公平原则的框架下,以自然延伸原则为基础,与日本方面协商解决东中国海大陆架的争端;日本方面则坚持对其有利的所谓的“中间线”划界方法,但其并非习惯法规则,且不符合东中国海的实际情况,因此不应成为划分两国大陆架的界线。针对中日东中国海大陆架划界存在的问题,国内外学者多数主张采取共同开发、提交国际司法机构审判、仲裁等政治、法律方面的措施解决。为了更好的解决这一争议,应综合运用政治法律的方法,在其海底和上覆水域进行不同的划界,然后提交国际法院进行裁决。
How to divide the continental shelf is the fundamental point of disagreement between China and Japan over the issue of the East China Sea. Analyzing this dispute from the point of view of international law, China advocates the settlement of the dispute over the East China Sea continental shelf through consultation with Japan on the basis of the principle of natural extension under the principle of fairness. Therefore, it should not become the dividing line between the continental shelf of the two countries. In response to the existing problems in the demarcation of the China-Japan East China Sea continental shelf, most scholars both at home and abroad advocate the adoption of political, legal measures such as joint development and submission to international judicial bodies for trial and arbitration. In order to solve this dispute better, we should make comprehensive use of political and legal methods to carry out different demarcation of its seabed and overlying waters and submit it to the International Court of Justice for ruling.
