法律法规和标准都有其生命周期,即制定、实施、修订、再实施,直到废除的过程。它们之间也存在着异同之处。为了便于法律法规的立法过程和标准生命周期过程进行比较分析,本文主要就行政法规、部门规章和国家标准、行业标准的生命周期的第一阶段,即立法过程和标准制定过程进行了比较分析和研究。技术法规,尤其是强制性标准是联结法律与标准的重要纽带,也是相关法律立法过程中必须高度重视和考虑的一个重要方面。
Laws and regulations and standards have their life cycle, that is, from the formulation, implementation, revision, re-implementation, until the abolition of the process. There are also similarities and differences between them. In order to facilitate the comparative analysis of the legislative process and the standard life cycle process of law and regulation, this paper mainly analyzes and compares the legislative process, standard process and the first stage of the life cycle of administrative regulations, departmental rules and national standards and industry standards and the study. Technical regulations, especially mandatory standards, are important links between laws and standards. They are also an important aspect that must be given due consideration and consideration in the relevant laws and legislation.
