一、检察机关参与民事诉讼尚无法律依据。我国的《人民法院组织法》和《人民检察院组织法》没有关于检察机关参与民事诉讼的规定。检察机关应当参与民事诉讼的观点,其主要法律依据为我国《民事诉讼法(试行)》第12条的规定,即“人民检察院有权对人民法院的民事审判活动实行监督。”认为实行监督就是参与诉讼,或者说不参与民事诉讼就无法实行监督,把对民事审判活动的监督与参与民事诉讼等同起来。笔者认为,正确认识和理解《民事诉讼法(试行)》第12条的规定,是分析判断检察机关参与民事诉讼有无法律依据的关键所在。首先,从文字释义的角度分析,实行法律监督与参与民事诉讼的内涵与外延均有很大差异,是两个不同的概念。实行法律监督是针对审判活动而言,是对于人民法院在审理民事案件过程中是
First, there is no legal basis for procuratorial organs to participate in civil litigation.
