农村宅基地使用权是我国特有的一种用益物权形式,一直以来专家学者对此问题的研究相对缺乏。《物权法》颁布之前社会上存在着宅基地使用权流转的隐性市场,也产生了放开宅基地使用权流转市场的呼声,《物权法》对此作了相对保守但又留有余地的规定。通过对我国有关农村宅基地使用权的现行法律制度及管理现状中存在的问题进行探讨,分析了目前农村宅基地使用权市场不宜放开的原因,并对农村宅基地使用权的流转提出了相应对策。
The right to use land in rural homestead is a form of usufructuary right peculiar to our country. So far, there has been a lack of research on this issue by experts and scholars. Before the promulgation of the Real Right Law, there was a hidden market in the society where the right to use the homestead was transferred, and the call for letting go of the right to use the homestead to transfer to the market also came into being. The Real Right Law made a relative conservative but left room for it. Through the discussion of the current legal system and the existing problems in the management of the right to use homestead in rural areas in our country, the reasons why the market of right to use homestead in rural areas should not be let go are analyzed, and the corresponding transfer of the right to use homestead in rural areas is proposed Countermeasures.
