BOLAR例外是指“制造、使用、许诺销售、销售或者进口被授予专利的发明的行为,如果单纯是为了依照有关法律的规定获得并提供为制造、使用或者销售药品或者兽医用生物产品所要求的有关信息,则不构成侵犯专利权的行为。”本文通过对我国BOLAR例外相关法律的介绍,针对我国目前的现状,提出我国BOLAR例外实施中需要关注的问题及其解决方法。
