以1988年4月的宪法修正案和1990年5月《中华人民共和国城镇国有土地使用权出让和转让暂行条例》的颁布实施标志着我国土地有偿使用制度业已确立,但严重的理论准备不足和立法上的缺陷,使得土地有偿使用制度中的许多法律理论和实际问题无论在学界还是在实践中,均有不同的认识和操作,严重阻碍了该制度的完善和健全。本文对此进行探讨,欢迎大家继续踊跃来稿各抒己见。
The promulgation of the constitutional amendment of April 1988 and the promulgation of the Provisional Regulations on the Transfer and Use of State-owned Land in the Towns of the People’s Republic of China in May 1990 marked the establishment of the system of paid use of land in our country but the serious theoretical under-preparation and legislation Many legal theories and practical problems in the system of paid use of land have different cognitions and operations both in academia and in practice, which have seriously hindered the improvement and perfection of the system.
