第一条为规范城市房屋拆迁证据保全公证活动。根据《中华人民共和国公证暂行条例》、《城市房屋拆迁管理条例》、《公证程序规则(试行)》,制订本细则。第二条房屋拆迁证据保全公证是指在房屋拆迁之前,公证机关对房屋及附属物的现状依法采取勘测、拍照或摄像等保全措施,以确保其真实性和证明力的活动。第三条本细则适用于《城市房屋拆迁管理条例》规定的拆除依法代管的房屋,代管人是房屋主管部门的;拆除有产权纠纷的房屋;在房屋拆迁主管部门公布的规定期限内纠纷未解决的;拆除设有抵押权的房屋实行产权调换,抵押权人和抵押人在房屋拆迁主管部门公布的规定期限内达不成抵押协议的以及其他房屋拆迁证据保全的公证事项。第四条房屋拆迁证据保全公证,由被拆迁房屋所在地公证处管辖。第五条房屋拆迁证据保全公证申请人是拆迁人或被拆迁人,房屋拆迁主管部门也可以作为申请人。上述申请人可以委托他人代为提出公证申请。第六条申请人应填写公证申请表,并提交下列材料:(一)身份证明;申请人为法人的,应提交法人资格和法定代
