在司法改革的大背景下,国家大力弘扬以审判为中心的司法改革模式。为推动以审判为中心的司法架构,保证法官的审判独立、审判中心的正确运转,不仅要摒弃前阶段的案卷主义的审判模式,还要从制度的架构中思考制约法官审判监督权的因素。毋庸置疑,检察院作为法律监督机关,享有对法庭审判活动的监督权的同时拥有公诉权,显有不妥。从两者的法理冲突入手,探讨中国现行法律构造产生的原因,并提出以人民监督为启动点,推动全国人民代表大会的法制工作委员会专门监督法庭审判的工作。
Under the background of judicial reform, the state vigorously promotes the judiciary reform model centered on trial. In order to promote the justice-centered judiciary structure, to ensure the independence of the judges and the correct operation of the judicial center, we should not only abandon the trial mode of the archives of the previous stage but also consider the factors restricting the judge’s supervisory authority from the institutional framework. Undoubtedly, it is obviously inappropriate for procuratorates, as the legal supervisory organs, to have the right of public prosecution while enjoying the supervisory power over the judicial activities of the courts. Starting from the conflict of jurisprudence between the two, this paper explores the causes of the current legal structure in China and proposes that the people’s supervision should be used as the starting point to promote the legal work committee of the National People’s Congress to supervise the court trial.
