司法改革的大幕拉起,顶层设计即将带来连锁的制度修改(甚至再修改)。对于法官的遴选、惩戒、保障等,多有讨论。然而,很少有人从法官职业伦理的应然秩序角度联想本轮司法改革的潜在意义。如果当前的法官责任制能够成功推行,可以实现法官独立、豁免和责任的三位一体,引发法官职业伦理的秩序归位。
The curtain of judicial reform has been brought up, and the top-level design is about to bring about a chain of system changes (or even revisions). There are many discussions about the selection, punishment and protection of judges. However, few people think of the potential significance of this round of judicial reform from the perspective of the proper order of judges’ professional ethics. If the current system of judges ’responsibility can be successfully implemented, the triad of judges’ independence, immunity and responsibility can be realized, and the order of the judge’s professional ethics can be put in place.
