云端运算(Cloud Computing)是2007年10月Google宣布与IBM所建立蓝云(Blue Cloud)全球资料中心后出现的名词,本文首先介绍云端运算起源、定义、型态及其优势;云端运算最大的特点是不需维护,随时都可存取其内容和服务,对于企业而言,因为资料的储存与取得都透过网络,由云端运算架构主动处理虽可大幅降低公司成本,但也隐藏公司机密信息遭窃取的危机,因此,说明由美国实务探讨云端运算产生的法律争议有其实益,如与智慧财产权有关的争议及与信息保护有关的争议;再者,云端运算涉及的法规范围宽广,本文以资讯保密与网络通讯为分类标准,说明云端服务可能牵涉的法规;其次,美国虽一向采行不成文法(common law)为案件审理法源,既以案例经验传承为主,本文借由分析现况,包括美国中小企业的运用实务和个人资料保障的隐忧;最终提出建议,希冀能为台湾地区在相关案件之处理以供参考。
