一、绪言在日本,为了保障船舶交通的安全,批准采纳了《1972年国际海上避碰规则》,此外,还先后制定了《海上避碰法》(1977年法律第62号)、《海上交通安全法》(1972年法律第115号)及《港则法》(1948年法律第174号)。本文就上述三个法律的制定过程、现状以及修改原因等作了简单介绍,并提出今后在制定、修改海上交通规则时应考虑的诸问题。
I. INTRODUCTION In Japan, the “International Rules for Collision Avoidance at Sea 1972” was approved in order to ensure the traffic safety of ships. In addition, the “Collision Avoidance Act of the Sea” (1977 Law No. 62) was successively enacted, and the "Maritime Traffic Security Act 1972 (Law No. 115) and the Hong Kong Zea Loi Act (Law No. 174 of 1948). This article briefly introduces the process of establishing the above three laws, the status quo and the reasons for such amendments, and puts forward some issues that should be considered in formulating and amending the maritime traffic rules in the future.
