为了改变我国法学教育无法培育法律人的困境,我国引进了不具有法学背景的法律硕士培养模式。但由于这种模式并没有实现预期目标,于2009年又新增了具有法学背景的法律硕士培养模式。两种模式在相当程度上存在暗合——无法按照设计培育出符合法治要求的法律人。我们必须从原点——法律职业需要什么样的法律素质或者职业能力——入手分析其原因,即我国法律职业教育缺乏智能技能培育过程及其教学方法。如果没能清楚地考察出当代中国法律职业教育的弊端,我国已经或者即将开展的法律职业教育改革只能是新瓶装旧酒而不具有实效。
In order to change our country legal education can not foster legal person's dilemma, our country has introduced legal master's training mode without legal background. However, since this model did not achieve the expected goals, in 2009 it added a law master's training model with a legal background. To a certain extent, the two models exist in such a way that lawyers who meet the requirements of the rule of law can not be nurtured as designed. We must start from the origin - what kind of legal quality or professional ability legal profession needs - to analyze its reasons, that is, the lack of intelligent skill cultivation process and its teaching methods in China's legal vocational education. Without a clear examination of the malpractices of legal vocational education in contemporary China, the legal vocational education reform that has been or will be conducted in our country can only be used in new bottled old wine without any actual effect.
