迪续权是著作权中一项权能,属于法学的研究范畴,但毫无疑问与之最密切相关的不是法学家,而是艺术家。尤其是随着近几年中国艺术品市场的聚集度与关注度的急速上升,艺术品拍卖价格一再飙升’远远超过艺术家首次转移作品所有权及著作权时获得的经济利益。这种现象几乎是艺术品市场所特有的价格与价值背离的体现,尽管并未违反自愿交易的基本原则,但其不符合经济学中的一般规律。同时,追续权入法仍然是国际趋势。本文以著作权精神权利为视角,并借鉴欧盟和美国的立法经验,探讨追续权保利益平衡、消除利益悬殊的功能,为实现著作权法的价值目标提供参考。
Discontinuity is a power in copyright and falls into the category of jurisprudence, but there is no doubt that the most closely related is not jurist but an artist. Especially with the rapid increase in the degree of concentration and attention of the Chinese art market in recent years, the auction prices of works of art have soared again and again far surpassing the economic benefits gained by artists when they first transferred the ownership and copyright of works. This phenomenon is almost a manifestation of the deviation of price and value peculiar to the art market. Although it does not violate the basic principle of voluntary trade, it is not in accordance with the general laws of economics. At the same time, the right to continue into the law is still an international trend. From the perspective of spiritual right of copyright and drawing lessons from the legislative experience of European Union and the United States, this paper explores the function of restoring the balance of interests and interests and eliminating the disparity of interests so as to provide reference for realizing the value goal of copyright law.
