当前面临公证立法,关于公证制度建设的诸多问题.各方面还有一些认识上的分歧。重新审视我国公证制度的法律定位和价值取向,研究、探索新的制度框架,对进一步完善我国公证制度,明确公证管理部门工作的努力方向,必定有所裨益。一、完善我国公证制度的理论起点和实践基点完善我国公证制度.需要明确理想、适用的制度模式,需要明确公证制度在我国法律制度中的定位,需要正确处理外来制度本土化的问题,也需要正确处理现有公证制度自身的传承转型关系,这些因素决定我国公证制度的未来走向。(一)我国公证制度设计应主要借鉴大陆法系国家的公证制度。基于不同的法律文化传统和经济、社会管理理念,现代公证制度主要区分为英美法系模式和大陆法系模式。大陆法系模式(又称拉丁公证制度)将公证制度视为一种准司法制
