不符点产生的原因应该是单据与信用证条款、UCP600相关适用条款以及国际标准银行实务之间产生了冲突,存在矛盾。在2014年中国信用证法律及实务年会和保函会议上,与会专家曾讨论过一个问题:不符点是单据与信用证条款、UCP600相关适用条款以及国际标准银行实务不一致,还是单据与信用证条款、UCP600相关适用条款以及国际标准银行实务相冲突?这个问题看似很简单,其实意义很大。众所周知,独立抽象性与单证相符是信用证的两大基石,也是信用证能够在结算手段日新月异的今天仍然能够占据一席之地的重要原因。
