新修订的《中华人民共和国食品安全法》(简称《食品安全法》)自2015年10月1日起施行。该法在2009年制定的基础上作了多处重大修改,首次确立了首负责任制和保底赔偿制度,扩大了食品生产经营者与相关责任主体承担连带责任的范围,加大了对制售不安全食品的处罚力度,强化了食品生产经营者和相关责任主体的责任,体现了重典治乱和严惩重处的原则,对人民法院依法公正审理食品纠纷案件必将产生重大影响。现就该法中几个重大民事问题的理解和适用谈些浅见。
The newly revised “Food Safety Law of the People’s Republic of China” (“Food Safety Law”) came into force on October 1, 2015. The Law made a number of major changes on the basis of the formulation made in 2009, establishing the system of first liability and minimum compensation for the first time, expanding the scope for the joint responsibility between the food producer and the relevant responsible parties, The penalties for unsafe food have strengthened the responsibility of food producers and operators and relevant responsible parties, reflected the principle of “treating SARS with severe penalties and punishing others through heavy penalties”, and will surely have a significant impact on the trial of food disputes in accordance with the law by the people’s courts. I now have some humble views on the understanding and application of several major civil issues in the law.
