台湾大学社会学系林端教授于2003年出版的《韦伯论中国传统法律:韦伯比较社会学的批判》一书,全面系统地批判了韦伯关于中国法律传统的论断。该书在社会学方法论上,指出了韦伯比较社会学里二元对立的理想型比较的局限;在实质社会学分析上则结合学界对清代法律和司法审判研究成果,说明了韦伯对中国传统法律与司法审判的看法的误解与限制。在此基础上,林端教授认为若要深刻理解中国法律传统,关键在于把握体现于其中的“多值逻辑”。
In his 2003 book, Weber’s Criticism of Traditional Chinese Law: Comparison of Weber’s Sociology, Professor Lin Dong, a sociology professor at National Taiwan University, published in 2003, which comprehensively and systematically criticized Weber’s thesis about the Chinese legal tradition. This book points out the limitations of ideal comparison of binary opposition in sociology from the perspective of sociology. In the analysis of substantive sociology, combining with the academic research on the law and judicial trial of Qing Dynasty, Misunderstandings and limitations on the legal and judicial opinions. On this basis, Professor Lin Duan believes that to understand the Chinese legal tradition, the key lies in grasping the “multi-valued logic” embodied in it.
