住房是人类生活的必须品,关系到每一个人的生存以及幸福指数。改革开放之前,我国采取的是国家分配住房的形式,经济体制改革的发展使得福利分配住房的方式被货币分配方式所取代,由此产生了住房公积金制度。作为住房货币化改革的产物,公积金制度不仅增强了居民的住房消费能力,同时也为保障性住房建设做出了巨大的贡献。但是近年来房价的增加使得住房公积金制度中的缺陷逐渐暴露出来,制度运行偏离了住房保障制度设计的具体目标,从而引起了人们对住房公积金制度的质疑。这些问题的产生导致与住房公积金制度相关的法律建设无法正常的实施。本文主要从住房公积金法律制度开始探讨,进一步解析住房公积金强制缴存的义务。
Housing is a must-have for human life and relates to each individual’s well-being and happiness index. Before the reform and opening up, China adopted the form of state-allocated housing. The development of the economic reform led to the replacement of the Welfare system by the mode of currency distribution, which resulted in the housing provident fund system. As a result of housing monetization reform, the provident fund system not only enhanced residents’ housing spending power, but also made tremendous contributions to affordable housing construction. However, the increase of housing prices in recent years makes the defects of housing provident fund system gradually exposed, and the system deviates from the specific goal of housing security system design, which has aroused people’s doubts about the housing provident fund system. These problems led to the legal system related to housing provident fund system can not be implemented normally. This article mainly from the legal system of housing provident fund to start to further resolve the obligation of compulsory deposit of housing provident fund.
