犯罪原因是复杂多元的,除了同犯罪分子本身的一些特质有关系以外,同社会的政治、经济、文化、环境甚至立法等因素也密切相关。虽然刑罚具有预防的功能,但犯罪的预防不能同于刑罚,我们不能简单的把犯罪预防这样一种社会共同的责任简单的寄希望于刑罚,刑罚不是万能的,只是在不得以的情况下才去发动的一种用于维护社会保障人权的手段。犯罪的预防除了刑法的措施以外我们还应该从社会的各种政策下工夫,尤其是不能忽视教育的作用和意义。
