近年来,随着城市化进程的加快,围绕土地占用产生的矛盾越来越多,原有的《城市房屋拆迁管理条例》也日显滞后。制定《国有土地上房屋征收与补偿条例》,规范国有土地上房屋征收与补偿活动,是必要而迫切之举。特别是2010年以来,各地有关征地拆迁的恶性事件频发,社会上对尽快出台新条例的呼声不绝于耳。《国有土地上房屋征收与补偿条例(草案)》,经历了2010年内两度公开征求意见,共收到来自社会各界近10万条意见;2011年1月19日,国务院常务会议审议并原则通过《国有土地上房屋征收与补偿条例(草案)》,2011年1月21日,正式颁布施行。《国有土地上房屋征收与补偿条例》作为行政法规,一年之内连续两次公开征求意见,广求民智,集纳民意,在谋求房屋征收与补偿制度完善的同时,也彰显了国家立法的进步。本期会客厅对话中国社会科学院研究员孙宪忠、北京大学法学院教授姜明安、建筑杂志社总编贾衍邦,共同探讨《条例》修编的意义和执行中要解决的问题。
