拥有148个成员、贸易量占世界贸易95%以上的世界贸易组织(通常简称为 WTO)是当今世界上最大和最有影响的政府间国际经济贸易组织,其宗旨在于使贸易以尽可能自由的方式进行,并争取通过谈判不断扩大贸易的自由化。WTO 以一套内容丰富、条文浩繁的法律框架,作为组织多边贸易谈判、执行贸易规则、解决成员之间贸易争端的规范和手段。根据乌拉圭回合谈判(1986-1993年)通过的建立 WTO 的协定附件《关于争端解决规则和程序的谅解》(通常简称为 DSU)所建立的 WTO 争端解决机制在 WTO 法体系中具有核心地位。笔者之所以将当今最复杂、最有效率但名称不叫法院的 WTO 争端
