我国1954年宪法中规定公民有迁徙自由,然而1958年的《户口登记条例》实质上以严格的户籍管理取代了这项权利。 建国初期,由于多年战争的影响,人口在地区之间迁移成为一种普遍的社会现象。人们并没有认为随意迁往他地居住存在着什么不方便或者是可以获得某种特殊的利益。1954年宪法对迁徙自由的规定是对现实中人们随意自由迁徙的一种法律肯定。
The 1954 Constitution of our country stipulates that citizens have the freedom to migrate. However, the 1958 Hukou Registration Ordinance essentially replaced this right with strict household registration administration. In the early days after the founding of New China, the migration of the population among the regions became a common social phenomenon due to the impact of many years of war. People do not think there is any inconvenience or some special interest in living freely. The 1954 Constitution provides for the freedom of movement as a legal affirmation of the freedom and freedom of movement of people in the real world.
