无单放货这一争议自实践出现以来一直争论至今,责任承担无疑是问题的核心。最高人民法院司法解释关于无单放货的规定在实践中具有重大的影响,而承运人免责部分规定的相对较浅。对承运人抗辩事由的了解和完善有利于保障我国海运平稳而高效的发展。尤其是催告制度,以及第三方的事前约定对无单放货的物权性质影响问题值得探究。
Since the advent of the controversial issue of releasing goods without a single parcel since the advent of practice, the assumption of responsibility has undoubtedly been the core of the issue. The Supreme People’s Court judicial interpretation of the provisions of non-draft released in practice has a significant impact, while the carrier exemption part of the provisions of the relatively shallow. Understanding and perfecting the defenses of the carrier is conducive to ensuring the smooth and efficient development of China’s maritime transport. In particular, the system of reminders, as well as the impact of the pre-contractual agreement of third parties on the nature of the real right of delivery of goods without a single bill, are worth exploring.
