在法治社会已逐渐完善的当代,研究法律与语言的关系问题已经成为法学研究的一个重要课题。法律和语言二者不可或缺,法律的特质有赖于语言的本体而存在,但是,语言本身的弊病又不可避免地模糊了法律用语的准确性,这就需要法律自身加以调节,可以说法律是语言的内在,语言是法律的外在表现。从边缘性学科的视角来看,法律和语言密不可分,语言是法律的载体和工具,法律又在一定程度上形塑着语言。从边缘性学科的视角研究法律与语言的关系可以助益法律的适用。
In the contemporary society where the rule of law has been gradually perfected, the study of the relationship between law and language has become an important subject in law research. Law and language are both indispensable. The law depends on the nature of the language. However, the shortcomings of the language itself inevitably obscure the accuracy of the legal language, which requires the law itself to be adjusted. It can be said that the law is The inner language, language is the external manifestation of the law. From the perspective of the marginalized discipline, law and language are inseparable, language is the carrier and tool of law, and the law is to a certain extent shaped by language. Studying the relationship between law and language from the perspective of marginalized disciplines can be helpful for the application of law.
