2012年公益诉讼制度确立,在最高法院关于民事诉讼法的司法解释中,第十三章对公益诉讼制度做了具体的规定,新修改的环保法对社会公益组织作为环境公益诉讼的主体做了具体的规定。随着社会经济的平稳增长,环境问题更加突出,人们开始更多的关注环境问题,我国的环境公益诉讼制度也在不断完善,但是对于环境公益诉讼的主体问题,法律并没有明确的规定,作为国家公共利益代表的检察机关,在是否能够作为环境公益诉讼的原告问题上,一直模糊不清。所以本文主要论述检察机关是否具有环境公益诉讼的原告资格,通过对两大法系关于检察机关提起环境公益诉讼程序的研究对比,得出我国检察机关提起环境公益诉讼的启示,构建我国检察机关提起环境公益诉讼的程序,并完善我国的环境公益诉讼制度。
In 2012, the public interest litigation system was established. In the judicial interpretation of the Supreme Court on the civil procedure law, Chapter XIII made specific provisions on the public interest litigation system. The newly revised Environmental Protection Law made the social welfare organizations as the main body of environmental public interest litigation Specific rules. With the steady growth of social economy, environmental problems are more prominent, people begin to pay more attention to environmental problems, and our environmental public interest litigation system is also constantly improving. However, there is no clear law for environmental public interest litigation. As a result, The procuratorial organs represented by the public interest in the country have always been ambiguous about whether they can act as plaintiffs for environmental public interest litigation. Therefore, this paper mainly discusses whether the procuratorial organs have the qualification of plaintiff in environmental public interest litigation. By comparing the two legal systems about procuratorate environmental public interest litigation procedure, this paper concludes the enlightenment from procuratorial organs in bringing environmental public interest litigation and constructs the environment of procuratorial organs in our country Public interest litigation procedures, and improve China’s environmental public interest litigation system.
