随着时代的进步公民的法制意识不断加强,曾经未被重视的教案一度成为知识产权案件争议的焦点。应该明确的是,首先应针对具体的案件来界定教案的属性,然后再根据教案的属性判断版权归属。我国在此类问题上存在立法空白,完善有关教案著作权的立法,打击不法的教案侵权行为,为鼓励教师教学钻研和保护知识产权提供有力的武器。
With the progress of the times, citizens’ consciousness of the legal system has been continuously strengthened. The lesson plans that once failed to be taken seriously have once become the focus of disputes over intellectual property cases. It should be clear that, firstly, the attributes of lesson plans should be defined according to specific cases, and then the ownership of copyright should be judged according to the attributes of lesson plans. China has legislative gaps on such issues, perfecting the legislation on the copyright of lesson plans, cracking down on infringements of illegal teaching plans, and providing powerful weapons to encourage teachers to study teaching and protect intellectual property rights.
