2007年出台的《物权法》,具体修正了《担保法》等针对抵押过程中抵押人转让抵押物的相关规定,可是由于没有颁布物权法的有关解释,在使用以及理解《物权法》条文方面,就会产生较多的异议,特别是在《物权法》第191条内容的规定。文章主要以该条的规范属性作为基础,就未经抵押权人同意条件下的抵押物转让为基本点,进行详细的分析。
