《全民所有制工业企业法》自1988年4月公布施行至今已三年有余了。从贯彻的情况看,有成绩,也有不足,必须作好进一步的推动落实工作。贯彻的初步成效主要是:分期分批推行了厂长负责制;实行了承包经营责任制;依照《企业法》的要求,深化了企业内部改革;企业基层党组织从一元化领导转变为企业政治核心;企业的民主管理工作得到加强等等。贯彻实施《企业法》过程中存在的问题是多方面的,集中表现在企业作为独立法人的权利没有得到应有的保障,企业的自我
The “National Ownership-Industrial Enterprise Law” has been in force for more than three years since it was announced in April 1988. From the perspective of implementation, there are achievements as well as deficiencies, and we must do a good job in furthering implementation. The primary results of the implementation were mainly: implementation of the director responsibility system in stages and in batches; implementation of the contract responsibility system; in accordance with the requirements of the “Corporate Law”, deepening the internal reform of the enterprise; and transforming the primary Party organization from a unified leadership to a corporate political core. The corporate democratic management work has been strengthened and so on. The problems existing in the implementation of the “Enterprise Law” are manifold, and are manifested in the fact that the rights of a company as an independent legal person are not properly protected.
