案例2005年,某市人民政府将一宗165亩的国有土地划拨给驻该市军分区,用途为办公用地。之后几年,由于种种原因该土地一直闲置。2008年7月,军分区准备将该地块转让给房地产公司,进行房地产开发建设,多家房地产公司就转让事宜与军分区进行了洽谈。军分区经过比较选择,最终与其中一家签订了土地转让合同。2008年9月,该房地产公司进行开工建设,被知情人举报到市国土局。国土局经过认真调查,对军分区下达了《行政处罚决定书》,并没收违法所得,军分区对所受处罚不服。
