目前用人单位规避劳动合同法律事件层出不穷,且规避手段不断翻新,隐蔽性更强。由于劳动合同法律制度不完善;法律执行力不强;维权途径不足,使得规避劳动合同法律活动更加泛滥。为对规避劳动合同法律行为进行充分有效地规制,应采取相应的对策:完善相关立法;加大执法力度;扩大维权途径。
At present, employers evade legal contracts in labor contracts one after another, and evasive means of evasion keep them hidden. Due to the imperfect legal system of labor contract, the weak enforcement of law and the lack of effective rights protection, the legal activities of avoiding labor contract have become more rampant. In order to fully and effectively regulate the evasion of legal acts of labor contracts, corresponding measures should be taken: perfecting the relevant legislation, intensifying law enforcement and expanding the ways of safeguarding rights.
