行政赔偿先行处理程序是解决行政赔偿争议的一种程序。行政赔偿先行处理程序模式的设定关系到行政赔偿争议能否在先行处理阶段得到有效解决。各国国家赔偿法一般都设有先行处理程序。虽然各国设定的先行程序处理模式不尽相同,但概括起来主要有决定式和协商式。我国国家赔偿法没有明确规定采用何种方式,但本文认为应当采取协商式附加决定式的模式。 Administrative compensation firsthand procedure is a kind of procedure to settle administrative dispute. The setting of the mode of preemptive processing of administrative compensation is related to whether the dispute of administrative compensation can be effectively solved in the pre-processing stage. National compensation laws in various countries generally have prior processing procedures. Although the proceeding procedures set by each country are not the same, they are mainly conclusive and negotiated. China’s State Compensation Law does not clearly stipulate which approach should be adopted, but this article argues that a consultative additional decision-making model should be adopted.
