对测谎结论的证据能力一直存在“肯定说”、“否定说”与“有限肯定说”的争论。从测谎的科学原理及测谎结论的可靠性来看,测谎结论具有客观性。从测谎的方法和内容看,测谎并不能对证明案件事实发挥实质性的作用,不具备证据的关联性。而且从我国目前的法律规定中难以找到其合法性根据。因此,测谎结论不具备证据能力,只能作为侦查辅助手段发挥其应用价值。 There is always a dispute over the evidence power of the polygraph conclusion, “positive”, “negative” and “limited positive”.
