2012年12月28日全国人大常委会通过决定,对《劳动合同法》进行了修改,并于2013年7月1日施行。这是自2008年《劳动合同法》实施以来的首次修改。针对劳务派遣无序发展、滥用劳务派遣、侵犯劳务派遣员工合法权益的突出问题,全国总工会于2011年向全国人大法工委提交了一份《劳务派遣报告》,显示全国劳务派遣人员达6000多万。有数据显示,116家中央企业存在劳务派遣用工,占央企总数的89%,劳务派遣用工共192万人,占职工总数的16%。
On December 28, 2012, the NPC Standing Committee passed the decision to amend the Labor Contract Law and implemented it on July 1, 2013. This is the first revision since the implementation of the Labor Contract Law in 2008. In view of the prominent problems of disorderly dispatching of labor dispatch, abuse of labor dispatching and encroaching on the legitimate rights and interests of labor dispatching staff, the All-China Federation of Trade Unions submitted a “labor dispatch report” to NPC Law Work Committee in 2011, showing that the number of dispatched staff members nationwide reached 6,000 Tens of thousands. Statistics show that there are 116 central enterprises dispatch labor, accounting for 89% of the total number of central enterprises, labor dispatching a total of 1.92 million, accounting for 16% of the total number of employees.
