在涉外民事诉讼中缓和管辖冲突,确定诉讼管辖权的重要内容之一就是协议管辖制度,即当事人在意思自治的基础上在争议发生之前或者之后约定特定的法院进行管辖,目前在涉外民商事领域,协议管辖已被大多数国家做接受。各国在国内的管辖制度中都设计了此制度,当然我国也是承认这一制度的,在立法和司法实践中也一直在发挥着确定管辖权、提高司法效率的作用。但在长期的实践中我国的涉外协议管辖制度依然有立法上的空白和司法实践中的处理混乱问题,对于已决案件的管辖权效力问题仍不确定。所以说我国目前司法实践中的重点研究问题应为:厘清制度的适用范围,增强形式要件的灵活性,贯彻弱者保护原则,立法上明区分国内外的协议管辖制度等。
One of the important contents of alleviating the conflict of jurisdiction in the civil litigation involving foreign affairs and determining the jurisdiction of the litigation is that the agreement jurisdiction system means that the parties agree on a specific court before or after the dispute arises on the basis of the autonomy of autonomy. At present, Agreement jurisdiction has been accepted by most countries. All countries have designed this system in the domestic jurisdictional system. Of course, our country admits this system, and in the legislative and judicial practice, it has also been playing the role of determining jurisdiction and improving judicial efficiency. However, in the long-term practice, the jurisdictional system of foreign-related agreements in our country still has the legislative blank and the chaos in the judicial practice. The validity of the jurisdiction of the decided cases remains uncertain. Therefore, at present, the key research issues in judicial practice in our country should be: to clarify the scope of application of the system, to enhance the flexibility of formal elements, to implement the principle of protection of the weak, and to make a legislative separation of the jurisdictional systems at home and abroad.
