《物权法》在解决建设用地使用权续期问题时采用了回避的态度,难以满足实践中化解矛盾冲突的需要。建设用地使用权续期并非土地公有制结构下特有的现象,自动续期与无需缴费之间并不存在必然的联系,现实困境源于对法的正当性的质疑而非法律规范体系的无解。虚幻的财产权预期是我国建设用地使用权续期制度的症结所在,有必要从财产权预期的视角出发,对建设用地使用权续期制度进行顶层设计与规则完善。
“Real Right Law” adopted the evasive attitude in resolving the renewal of the right to use construction land, which is difficult to meet the needs of resolving the contradictions and conflicts in practice. The renewal of the right to use construction land is not a peculiar phenomenon under the structure of public ownership of land. There is no necessary link between automatic renewal and non-payment of fees. The real difficulty stems from the questioning of the legitimacy of law rather than the solution of legal norms. Unreal expectations of property rights is the crux of the system of renewal of the right to use construction land in China. It is necessary to carry out the top-level design and improvement of the rules on the renewal system of the right to use construction land from the perspective of property rights.
