美国在反就业性别歧视救济方面是先行者。本文一方面选取“特纳”案从反就业歧视立法、行政执法、司法等多个层面来介绍美国反就业性别歧视救济机制。另一方面选取2013年中国就业性别歧视第一案的“曹菊”案、2014年浙江性别歧视案“黄蓉”案来分析中国在反就业性别歧视救济方面所存在的立法、行政执法以及司法救济等层面的问题。最终通过比较研究的方式,以期为完善中国反就业性别歧视救济制度方面提供建议。
The United States is the forerunner of anti-employment gender discrimination relief. On the one hand, this article selects “Turner ” case to introduce the United States anti-employment gender discrimination relief mechanism from the perspective of anti-employment discrimination legislation, administrative law enforcement and judicature. On the other hand, the “Cao Ju” case of the first case of sex discrimination in China in 2013 and the case of “sex discrimination case in Zhejiang” in 2014 “Huang Rong” were used to analyze the existing legislation and administration in China on the anti-employment gender discrimination relief Law enforcement and judicial relief and other issues. Finally, through comparative study, we hope to provide suggestions for improving China's anti-employment gender discrimination relief system.
