随着电子商务在我国的迅速发展,相关的法律机制与法律环境的建设也日益受 到人们的重视。电子商务认证机构(CA)作为电子商务的必然中介机构,更应引 起立法者的高度关注。本文在借鉴美国CA立法例的基础上,就建设、管理全国 CA认证中心的主体资格取得、全国 CA认证中心的法律地位及其性质等问题进 行了理论上的探讨,为我国这方面的立法提供参考。
With the rapid development of e-commerce in our country, the construction of relevant legal system and legal environment is also paid more and more attention. E-commerce certification body (CA), as an inevitable intermediary of e-commerce, should arouse the attention of lawmakers. Based on the reference of the legislation of CA in the United States, this article discusses the legal status and nature of the national CA certification center in terms of obtaining the qualification of the CA certification center in the country, managing the CA certification center in China, and providing the legislation for our country in this aspect reference.
