通过梳理案例教学法在中国法学教育中的遭遇,可以看到中国法学者对该教学方法的态度变迁,同时也可以看到它在中国法学教育实践的发展过程:第一个阶段,组织编撰案例教材(从而引发的案例教学法)的阶段;第二阶段,何美欢教授主导的案例教学法。通过检讨这两个阶段的得与失,提出案例教学法如果还要在中国继续实践,则必须实施严格的、英美法意义上的普通法方能达到教学效果和法学教育改革在这方面的目的。
By combing the experience of the case teaching method in Chinese legal education, we can see the change of attitude of the Chinese legal scholars to this teaching method. At the same time, we can see its development in the practice of legal education in China. In the first phase, Teaching materials (thus triggering the case teaching method) phase; the second phase, Professor He Mei Huan led the case teaching method. By reviewing the gains and losses of these two stages, it is suggested that if the case teaching method is to continue practicing in China, strict common law in the sense of Anglo-American law must be implemented to achieve the goal of teaching effectiveness and legal education reform in this respect .
