Affidavits and statements are statements of one or more persons signing and listing certain facts. The United States Patent and Trademark Office has two procedures that permit the use of affidavits and statements to overcome the claims in a patent application that have been rejected. Rule 131 (Code of Federal Regulations, rule 1.131) is a specific provision that specifies the facts that must be shown to confirm that the claimed invention was completed in the United States prior to the prior art expiration date. In contrast, Rule 132, Code of Federal Regulations, No. 1.132, is more generally and generally delegated to applicants for the purpose of submitting affidavits and statements to reverse the examiner’s refusal.
